Separate and organize company equity, stocks, real estate, investments, insurance, and liabilities;
2. The acquisition time and source of funds for each asset;
3. Company assets must be kept separate from shareholders' personal assets;
4. First confirm the legal valuation date of the property, then discuss its value.

The real difficulty in high-net-worth divorces usually isn't "how much money the couple has in total," but rather:

Which assets should be included? At what point should they be valued? What is the company's actual worth? Are the liabilities real or just book figures? And how much of the remaining asset difference will ultimately need to be paid?

Typical divorce cases may primarily deal with savings, real estate, and mortgages, but the asset structures of business owners, doctors, professionals, investors, or high-income families often also include:

Company equity;

Unlisted stocks;

Listed stocks, ETFs and funds;

Multiple real estate properties;

Insurance;

Employee stock options or restricted stock;

Overseas securities accounts;

Foreign currency and overseas assets;

Shareholder transactions;

Loans from shareholders to the company or claims by shareholders against the company;

In addition to premarital property, gifts from parents, inherited property, and post-marital investment income.

If this kind of case could be summed up in just one sentence:

"Divorce property is divided equally."

This often leads to completely wrong results.

Under Taiwan's statutory property system, what really needs to be calculated is the difference between the remaining assets of the couple after deducting relevant debts from their respective marital property, which is then distributed according to legal provisions.

Therefore, the first step in a high-net-worth divorce is not to rush to calculate "half of the total assets," but to first divide all assets into different types and then confirm each item:

The time of acquisition, source of funds, ownership, current value, liabilities, and whether it should be included in the calculation of remaining assets according to law.

First, high-net-worth divorces do not simply mean splitting all marital assets in half.

Many clients will ask at the beginning:

"Our family has about 100 million yuan, so if we divorce, it'll be 50 million yuan each?"

That's not how it's calculated.

according toArticle 1030-1 of the Civil CodeWhen a legal property regime is terminated, the principle is to first calculate the existing marital property of each spouse, deduct the relevant debts incurred during the marriage, and then compare the difference in the remaining property of both parties.

The difference should be distributed equally in principle.

Therefore, it is not:

Total marital property ÷ 2

And closer to:

Property to be included by Party A after marriage
- Debts to be deducted

and

Property to be included by Party B after marriage
- Debts to be deducted

After calculating them separately, compare the difference between the two.

In addition, the Civil Code explicitly excludes certain types of property, such as property acquired through inheritance or other gratuitous means, as well as compensation for loss or damages.

Therefore, the real difficulty in high-net-worth divorces is usually not the addition of assets, but rather:

To which category does the property belong?

You need to understand the general framework for calculating remaining assets first. You can refer to [link/reference].Distribution of remaining property after divorceFull explanation.

Second, the first step is to clearly distinguish between "premarital property" and "marital property".

according toArticle 1017 of the Civil CodeThe property of a husband or wife is divided into premarital property and postmarital property, which belong to each spouse respectively.

If it cannot be proven whether the property was acquired before or after marriage, the law generally presumes it to be acquired after marriage.

Therefore, a crucial task in high-asset cases is to "trace the source of the assets".

For example:

The husband already owned shares in a company called 30% before they got married;

The company underwent two more capital increases after the marriage;

Some of the additional funds came from post-marital salaries;

Later, they also acquired employee stock options.

The company distributed cash dividends during this period;

Part of the dividends are reinvested to purchase other stocks.

When it comes to divorce, you can't just look at:

"How many shares do you currently own, sir?"

But we must ask:

When were the original shares acquired?

Did they acquire any additional shares after marriage?

Where will the additional capital come from?

What did the company previously provide as part of its benefits?

Where do dividends go?

Which assets are simply a continuation of premarital property, and which were acquired after marriage?

High-asset cases often involve significant differences in the history of these assets.

Third, premarital property itself does not necessarily need to be divided, but the income generated after marriage needs to be considered separately.

Article 1017 of the Civil Code further stipulates:

The fruits generated from premarital property during the marriage are considered postmarital property.

Therefore, "this is my premarital property" does not mean that all benefits generated from it in the future automatically belong to the premarital property.

For example:

They already owned rental property before the marriage;

Continuing to receive rent after marriage;

There was a pre-marital deposit;

Interest accrues after marriage;

They had certain investment assets before marriage, and generated identifiable returns after marriage.

These all require a further distinction between the original assets themselves and the income gained during the marriage.

High-net-worth families, in particular, often reinvest their assets over a long period, potentially going through multiple rounds of reinvestment over a decade or more.

Interest payment;

Sell;

Reinvestment;

Share swap;

Capital increase;

Asset conversion.

Without proper documentation, it's easy for premarital and post-marital assets to become mixed up, making it impossible to clearly prove their origin.

Fourth, in cases of divorce among business owners, the money under the company's name is not directly divided equally between the spouses.

This is one of the most important concepts in high-net-worth divorces.

Suppose that Mr. holds shares in a company called 70%.

The company's accounts show:

50 million yuan in cash;

One factory building;

Machinery and equipment;

Accounts receivable;

trademark;

client;

stock;

And the bank loans that the company itself bears.

These assets belong to the company in principle, not to the gentleman personally.

The real issue in divorce cases involving remaining property is usually not:

"Give half of the company's bank deposits to your spouse."

Instead:

Whether the company shares held by the husband should be included in marital property, and what their legal value is.

These two things are completely different.

Company assets and liabilities may affect equity value;

However, the balance in a company's account cannot be directly regarded as a shareholder's personal deposit.

Similarly, real estate under a company's name cannot be directly listed as real estate under the name of one spouse simply because one spouse is a major shareholder.

When a high-net-worth divorce involves a company, the first thing to do is always:

Separate "company assets" from "shareholders' personal assets".

Other mattersShareholder disputes and company equity disputesWhen calculating marital property, this should be clarified separately from the calculation of marital property.

Is the divorce case involving company shares, real estate, or large investments?

If marital property includes companies, unlisted stocks, multiple properties, securities investments, or overseas assets, you can first compile a list of the main assets, their acquisition dates, holders, and currently available financial information, and then determine which items should be included in the remaining assets, and whether an appraisal or property investigation is needed.

Inquire about high-net-worth divorce cases on LINEDirect call

V. How to value company equity? It cannot be determined solely by the capital amount or par value of the shares.

The most common and biggest disputes when business owners divorce are:

"How much is this company actually worth?"

Some might argue:

"The company's capital is only 10 million yuan, so my 50% is worth at most 5 million yuan."

However, such algorithms are often insufficient to reflect the true economic value of a company.

A company may have only 10 million yuan in capital, but it has:

Stable profits over many years;

Large amounts of cash;

Key clients;

brand;

technology;

path;

land;

Related companies;

Or other assets with economic value.

Conversely, the capital amount may also be very high, and the company in reality:

Long-term losses;

Heavily indebted;

Insufficient cash flow;

It has even ceased normal operations.

Therefore, the equity valuation of unlisted companies usually requires further investigation:

Financial statements;

Balance sheet;

Income statement;

Cash flow data;

Shareholder equity information;

The company's main assets and liabilities;

Profits over the years;

Related-party transactions;

Shareholder transactions;

And other information that reflects the company's value.

When a case is complex, professional advice from accountants or valuation experts may be required.

The law does not stipulate that all unlisted companies can only use one valuation formula.

The real points of contention are usually:

Which method best reflects the equity value of this company on the benchmark date?

VI. Holding 30% shares should not be simply interpreted as "company value multiplied by 30%" and the transaction is not necessarily complete.

For example, the company as a whole is estimated to be worth 100 million yuan, with one party holding 30%.

On the surface, it seems to be:

30 million yuan.

However, further confirmation may still be necessary in practice:

Does 30% have voting rights?

Are there any special stocks?

Does the article of association restrict transfer?

Does the shareholder agreement include a right of first refusal?

Does the equity have controlling power?

Are there any restrictions on closed-loop companies?

Are there any other equity encumbrances?

And the actual liquidity of the equity.

These factors may influence both parties' claims to reasonable value.

Therefore, the equity of unlisted companies cannot be judged solely by:

Number of shares × par value.

We can't just look at things all the time:

Company net worth × shareholding percentage.

The determination should be based on the company's actual situation and the available evidence.

VII. Undistributed profits of the company cannot be directly treated as cash under the names of shareholders and counted again.

This is also a common issue of double counting in divorce cases involving business owners.

If a company makes a profit and the surplus remains with the company, it is, in principle, still part of the company's assets.

When assessing the equity value of a company, the company's retained earnings and cash may already be reflected in the enterprise value.

If at this point:

Company's undistributed profits

Treat it directly as:

Another personal deposit of the shareholder

Listing it again could lead to duplicate calculations.

However, if the company has already resolved to distribute dividends in accordance with the law, and the shareholders have already obtained specific dividend rights, or the funds have been actually paid into the shareholders' personal accounts, then the actual rights status and the base date must be used to determine the matter.

Therefore, high-asset cases cannot be summed up by looking at just one company's financial statement.

It is necessary to first determine which property belongs to:

company;

shareholder;

Or it refers to the shareholders' claims or other rights against the company.

8. Does "shareholder transactions" represent debts owed by the company to the shareholders, or debts owed by the shareholders to the company? This must be clearly separated.

Many small and medium-sized enterprises, family businesses, or startups have this in their accounts:

Shareholder transactions;

Shareholder loans;

Temporary loan;

Other receivables;

Other payables.

These figures can be very important in divorce property cases.

For example:

The company owes the spouse 5 million yuan.

If the spouse did indeed lend their funds to the company, and the company has an obligation to repay them, then it may mean that the spouse has a claim against the company.

The spouse owes the company 5 million yuan.

The legal and financial implications are completely different.

Therefore, one cannot simply conclude from the statement "shareholder transactions amount to 5 million yuan":

"He also has 5 million yuan in assets."

You must read this first:

Loan direction;

Actual remittance;

Accounting subjects;

contract;

Board of Directors or Shareholders' Meeting Minutes;

And whether there is actually an obligation to return the money.

9. Listed stocks, ETFs, and funds are generally easier to price, but the base date still needs to be confirmed first.

Compared to equity in unlisted companies, listed stocks, ETFs, or publicly traded funds usually have more readily available market price information.

However, there is still a very important issue in high-net-worth divorces:

Which day's price should we look at?

according toArticle 1030-4 of the Civil CodeThe value of the existing marital property of a couple shall, in principle, be determined when the statutory property regime is terminated.

If a couple divorces by court order:

The value of the property is generally determined at the time of filing for divorce.

Additionally, if it belongs toArticle 1030-3 of the Civil CodeFor any additional marital property that should be calculated, the value at the time of disposal shall prevail.

This is very important in stock cases.

For example, a stock:

The price is 100 yuan per share when filing for divorce.

A year later, during the court hearing, the amount was reduced to 200 yuan.

Or conversely, it could drop to 50 yuan.

If the base date is wrong, the entire property difference can result in a huge discrepancy.

Therefore, high-net-worth divorces should not only ask:

How many stocks do you own?

Another question:

What is the legal valuation date?

10. Overseas stocks, foreign securities firms, and offshore assets cannot be considered non-existent simply because they are not located in Taiwan.

Common characteristics of high-net-worth families:

US brokerage account;

Overseas funds;

Equity in overseas companies;

Foreign bank accounts;

foreign currency;

Overseas real estate;

Even the investment structures of different countries.

Having assets located overseas does not mean that they are exempt from being addressed in marital property cases in Taiwan.

What really needs to be confirmed is:

To whom do the property rights belong?

When was it obtained?

Source of funding;

Whether it belongs to marital property;

And whether sufficient data can be obtained to prove its value.

However, the difficulties in cases involving offshore assets usually lie in:

Data acquisition;

Document authenticity;

exchange rate;

Valuation;

Information on foreign companies;

And issues related to its implementation in the future.

Therefore, the earlier it is saved:

Brokerage Statement;

Bank statement;

Company equity information;

Transaction records;

Remittance records;

Generally, the more advantageous it is.

11. Virtual currencies and digital assets may also be part of the divorce settlement.

High-net-worth families may now also hold:

Bitcoin;

Ethereum;

Other crypto assets;

Exchange account;

Cold wallet;

Digital investment tools.

This type of property is not automatically excluded from the analysis of marital property simply because it does not have a traditional bank account.

However, the biggest practical problem is usually:

How to prove who owns it;

When was it obtained?

Obtaining funding sources;

Number of shares held as of the benchmark date;

And how to prove the value of the benchmark date.

If one party already possesses legally acquired:

Exchange reconciliation data;

Deposit records;

Wallet address;

Transaction records

All should be preserved as soon as possible.

12. High-priced real estate cannot be calculated solely based on the announced current value or the original purchase price.

High-net-worth divorces often involve:

Owner-occupied housing;

Luxury mansion;

Commercial office;

land;

Shop;

Renting out real estate;

They even made multiple joint investments in real estate.

For these properties, the real issue to be addressed is:

Market value on the benchmark date;

hold points;

Mortgage;

Remaining loan;

Other burdens;

And obtaining funding sources.

For example, a house purchased for 20 million yuan 15 years ago may now be worth 60 million yuan on the market.

Take only:

Original purchase price

Or simply take:

Announcement of Land Current Value

It may not fully reflect the true value of the property in dispute in the case of remaining property.

If necessary, it may be necessary to go through:

Market price data;

Valuation data;

Real estate valuation;

Other evidence

To determine a reasonable value.

Thirteen, the name under which the property is registered does not mean that the other party has no claim to property in a divorce.

Under the statutory property regime, marital property is, in principle, owned by each spouse individually.

therefore:

House under Mr.

Marriage does not automatically transform a relationship into one where the husband and wife each own half of the property.

But on the other hand:

Registered in Mr.'s name

This does not mean that the wife cannot claim any property rights during a divorce.

What we really need to see is:

When was the property acquired?

Whether it belongs to marital property;

Obtaining funding sources;

Existing value;

Related debts;

And the difference after including the remaining property of both parties after marriage.

Therefore, "ownership registration" and "distribution of remaining property difference" are two different issues.

The divorce settlement system typically does not directly divide the ownership of the house in half to the other party. Instead, it calculates the difference in the marital assets of both parties and generates a corresponding distribution request.

Fourteen, the issue of buying a house before marriage and paying the mortgage after marriage cannot be resolved simply by stating "pre-marital property is not subject to division."

This is a very common situation for high-net-worth families.

For example:

The husband bought a house before the marriage;

They still had a loan of 20 million yuan at the time of their marriage;

The income was used to continuously repay the loan after marriage.

At this point, we cannot simply stop the analysis because the house was acquired before the marriage.

Article 1030-2 of the Civil CodeIt deals with the issue of compensation calculation when settling debts with different sources of assets.

If marital property is used to pay off premarital debts, the remaining property may still need to be included and compensated in accordance with the law when the statutory property regime is terminated.

Therefore, high-asset cases must include:

Date of asset acquisition;

Loan initiation date;

Repayment after marriage;

Source of repayment funds

Organize them separately.

15. Gifts from parents, family inheritances, and other forms of property inherited should not be mixed with ordinary post-marital income.

Article 1030-1 of the Civil Code clearly stipulates:

Property acquired through inheritance or other gratuitous means is generally not included in the distribution of the remaining property.

Therefore, high-asset families often have the following characteristics:

Cash gift from parents;

Real estate gifted by parents;

Gift of shares in a family business;

Inherited stock;

Inheriting land;

Inheriting company shares

It may be necessary to handle this separately from income earned from work or investments after marriage.

But the real difficulty is:

Years later, this asset may have been sold, reinvested, or mixed with other funds.

For example, after parents give 10 million yuan:

Use it to buy stocks;

Sell the stocks and then buy a house;

The mortgage has been increased again;

The funds are reinvested in the company.

The most crucial thing at this point is:

Can the source and conversion of the property be proven?

Therefore, in high-asset cases, the "flow of funds" is often just as important as the amount of the assets themselves.

Further reading is available in the relevant source categories.Determining premarital property, gifts, and inheritance.

Sixteen, insurance policies may also need to be reviewed, but you can't just look at the sum insured.

High-net-worth families often hold:

Savings insurance;

Investment-linked insurance policies;

Annuity insurance;

Life insurance;

Foreign currency insurance policies;

And insurance products with a certain cash value.

When analyzing assets in a divorce, you can't just look at:

"What is the death benefit?"

What really needs to be confirmed is:

You must protect people;

The insured;

Beneficiary;

Source of premiums;

Policy value reserves;

cancellation fee;

And whether there are any appraiseable property rights as of the benchmark date.

Different policy structures can vary greatly, so a single number cannot be used to treat them all the same.

17. Employee stock options, RSUs, or restricted stock should not be judged solely on the company's current stock price.

For employees of technology companies, senior managers, or multinational corporations, common assets also include:

Employee stock options;

Stock Options;

Restricted Stock Units (RSU);

Restricted stock;

Rewards programs that have not yet been fully realized.

These rights need to be confirmed first:

Date of grant;

Established conditions;

Whether specific rights have been acquired at present;

Can it be transferred?

Exercise price;

Base date status;

And conditions such as whether there are still years of service remaining.

Therefore, we cannot only see:

"The company's stock is currently priced at $100 per share."

They simply calculated all the undeveloped reward programs based on their full stock value.

It should be confirmed first what legal and property rights the parties involved possess on the benchmark date.

18. One of the biggest pitfalls of high-asset divorces: mixing real debts with "debts incurred for the divorce."

When assets are plentiful, liabilities are usually also plentiful.

Possible includes:

Mortgage;

Corporate loans;

Securities financing;

Private loans;

Shareholder loans;

Overseas loans;

Joint and several guarantee;

And other financial burdens.

but:

There is a liability account on the books.

This does not mean that all assets will be deducted in the calculation of divorce property.

Especially when it suddenly appears after the breakdown of the marital relationship:

He owes his parents 20 million yuan.

Owes 10 million yuan to his brother;

Shareholder transactions surged;

Borrowing money from a friend;

Or debts with only IOUs but no cash flow.

Further verification is needed:

When does the debt arise?

Was the principal actually delivered?

Where did the money go?

Has it been repaid?

Is there interest?

Whether past financial records have been kept.

In high-net-worth divorces,The authenticity of debts is sometimes more likely to become the core of litigation than asset valuation.

19. A personal guarantee from the company's responsible person does not necessarily equate to an incurred debt of the same amount.

Business owners often provide loans for their companies:

Joint and several guarantee;

Promissory note;

guarantee;

Other personal responsibilities.

However, in divorce property cases, it is still necessary to distinguish:

Debts that have now been identified as existing and that should be borne by the individual;

and

What may happen in the future and what responsibilities may be incurred.

Just because a business owner once guaranteed 50 million yuan for the company does not automatically mean that 50 million yuan must be deducted from his personal assets.

The determination still needs to be made based on the content of the debt, the performance of the debt, whether the company has made normal repayments, and the actual legal responsibilities of the parties involved.

20. Which date should be considered when assessing the value of stocks, real estate, and companies? For high-asset cases, it's crucial to first determine the base date.

In high-net-worth divorces, the issue most likely to cause a gap of millions or even tens of millions of yuan is:

Valuation date.

According to Article 1030-4 of the Civil Code:

The value of a couple's existing marital property is, in principle, determined when the statutory property regime is terminated.

If a couple divorces by court order:

The value of the property is calculated based on the time of filing for divorce.

If it is marital property added to the calculation due to separation of property under Article 1030-3 of the Civil Code:

The value at the time of disposal shall prevail.

This pair:

Listed stocks;

Unlisted companies;

real estate;

fund;

foreign currency;

Virtual currency

Especially important.

Because the prices of these assets can change dramatically within a year.

Therefore, once a high-asset divorce case is initiated, it should be confirmed as soon as possible:

What exactly is the legal valuation date?

21. If the other party suddenly transfers their shares, stocks, or real estate before the divorce, the issue of asset divestment needs to be handled separately.

High-asset cases occur frequently:

The company's shares were suddenly transferred to relatives and friends;

Large quantities of stock were sold.

Property transfer;

Funds were transferred overseas;

Gift to children or parents;

Unexplained transactions suddenly occurred.

At this point, it's no longer just a question of "how to estimate the price".

It may also involve:

Article 1020-1 of the Civil CodeCancel;

Additional calculations are required under Article 1030-3;

Adopt a separate property system;

And property preservation measures such as false seizure.

This part should not be repeated in this article.

If you have discovered that your spouse is transferring assets, you should read the following directly:

「Pre-divorce asset transfer, concealment of assets, and false attachment"

The complete processing method.

22. What should I do if I don't know what companies, stocks, or bank accounts my spouse has?

High-net-worth families often experience extreme information asymmetry.

For example:

The gentleman has been in charge of the company for a long time;

The wife only knew the company name, but didn't know she actually held shares.

One party manages all investment accounts;

The other party didn't even know which country the overseas brokerage firm was located in.

Article 1022 of the Civil CodeThe regulations stipulate that spouses have a mutual obligation to report on their marital property acquired after marriage.

After entering the family court proceedings, according toArticle 17 of the Family LawThe court may also, when necessary, instruct:

Police agencies;

Tax authorities;

Financial institutions;

Other relevant agencies or organizations

Investigate and ascertain the financial status of the parties involved or related persons.

However, this does not mean that every case can uncover all assets worldwide at once.

In particular, there will still be issues with obtaining information and cross-border verification for overseas companies, overseas banks, or foreign securities firms.

Therefore, what the parties involved legally possess:

Company Name;

Brokerage firm name;

Bank name;

Past Statement;

Email;

Company equity documents;

Overseas remittances;

Tax filing documents;

Both are very important.

23. Is half always the remaining property? The court can adjust this.

The basic principle of Article 1030-1 of the Civil Code is that the difference in remaining property shall be distributed equally.

However, the law also clearly stipulates:

If one spouse makes no contribution or cooperation to the marriage, or if other circumstances exist that make an equal distribution manifestly unfair, the court may adjust or even waive their share.

When making a judgment, the law requires comprehensive consideration:

Household chores;

Childcare and upbringing;

Overall cooperation within the family;

Time spent living together and time spent apart;

The timing of the acquisition of marital property;

Both parties' economic capabilities;

Factors such as these.

therefore:

The party receiving the higher income cannot simply say:

"I earned all the money, so the other party shouldn't get a single penny."

Taking care of family and children is also a marital contribution that the law requires the court to consider.

On the other hand, not every case must be mechanically distributed equally.

If there are indeed legal grounds for adjustment, specific facts and evidence can still be presented.

24. In high-asset cases, the final step is often not to "divide the assets," but to design an executable exit strategy.

Assume the final calculation is:

The husband should pay his wife the remaining asset difference of 30 million yuan.

But Mr.'s main assets are:

Company equity;

real estate;

Long-term investment;

Instead of 30 million yuan in cash.

At this point, what both sides really need to deal with is not just:

"Who has the legal right to take how much?"

Also includes:

How to pay;

Should I pay in installments?

Whether to use real estate transfer as collateral;

Whether to use other assets to settle the debt;

Is the company's equity suitable for transfer?

Will it affect the company's operations?

Do we need to handle tax, loan, and mortgage matters simultaneously?

Litigation can determine legal rights.

However, in high-net-worth divorces, if there is room for negotiation, it is often necessary to convert the legal outcome into a truly enforceable property settlement.

In cases involving business owners, it is especially important to avoid creating new problems related to company operations, financing, or management rights simply by focusing on the division of marital property during divorce proceedings.

25. What documents should be prepared first when a high-net-worth individual gets divorced?

If your assets are complex, it is recommended to first divide them into six categories.

Category 1: Companies and Equity

Company registration;

Shareholder register;

Each capital increase;

Equity transfer;

Articles of Association;

Financial statements;

Shareholder transactions;

Information on dividends and bonuses.

Category Two: Securities and Investment

stock;

ETF;

fund;

Bonds;

Securities account;

Foreign brokerage firms;

Employee stock options;

RSU;

Other investment products.

Category 3: Real Estate

land;

houses;

hold points;

Purchase time;

Purchase price;

Current loan;

Mortgage;

Rental income.

Category 4: Finance and Insurance

Bank deposits;

foreign currency;

Fixed deposit;

Insurance policy;

Investment-linked insurance policies;

Other financial products.

Category 5: Overseas and Digital Assets

Overseas accounts;

Foreign companies;

Overseas real estate;

Foreign securities;

Virtual currency.

Category 6: Liabilities

Mortgage;

Credit loans;

Private loans;

Shareholder loans;

Company dealings;

Financing;

Guarantee responsibility.

Then each asset is further labeled:

Date of acquisition;

Source of funding;

Before or after marriage;

The current nominal person;

Current value;

Does it have any debts?

Is the information complete?

Only by reaching this stage can one truly begin to lay the foundation for high-net-worth divorce negotiations or litigation.

Frequently Asked Questions about High-Asset Divorce (FAQ)

If my spouse owns the company, can I directly claim half of it in a divorce?

This is not usually the case. A company is an independent legal entity, and its deposits, equipment, and real estate are not automatically divided equally between the spouses simply because a shareholder divorces. The real analysis involves determining whether the spouse's company shares qualify as marital property and their fair value on the valuation date.

How do you determine the value of stocks in unlisted companies?

There is no single formula that applies to all cases. Typically, it's necessary to examine a company's financial statements, balance sheet, profitability, cash flow, major assets, liabilities, and equity restrictions. Accounting or valuation professionals may be required in some cases. Simply looking at capital or par value is usually insufficient to reflect the full value.

If you own company shares before marriage, are they absolutely not considered in a divorce?

One cannot draw conclusions simply because the shares are still registered under one's name. It is necessary to first confirm the original acquisition date of the shares, and whether there have been any capital increases, dividends, bonuses, additional shares, or other asset conversions after the marriage. Civil law also stipulates that the fruits of premarital property generated during the marriage are considered marital property; therefore, the source of each item still needs to be traced.

If my parents gift me a house or company shares, will I be entitled to them in a divorce?

According to Article 1030-1 of the Civil Code, property acquired through inheritance or other gratuitous means is generally not included in the distribution of remaining assets. However, if the property has been sold, reinvested, or mixed with other assets many years later, it is necessary to provide documentation to prove the original source and subsequent transfer.

If the other company has 100 million yuan in its accounts, can we directly say that it has 100 million yuan in assets?

No. Company assets and shareholders' personal assets must be kept separate. Cash on the company's books belongs to the company and may affect the company's equity value, but it cannot be directly treated as shareholders' personal deposits and recalculated.

If a company has a lot of undistributed profits, can all of them be added to the shareholders' personal assets?

This approach is not feasible. Undistributed profits are, in principle, still company property and may already be reflected in the company's equity value. Adding them back as complete shareholder property could result in double counting. The determination must be based on company resolutions, the status of dividend rights, and valuation data.

When divorcing a couple, should the stock price be based on the price at the time of the lawsuit or the price at the time of the court's judgment?

According to Article 1030-4 of the Civil Code, if the divorce is granted by court judgment, the value of existing marital property is generally based on the value at the time of the divorce lawsuit; if the property is added to the divorce settlement according to Article 1030-3, the value is based on the value at the time of disposal. Highly volatile assets especially require confirmation of the correct valuation date.

In a high-net-worth divorce, is it necessary to sell the company or house in order to divide the assets?

Not necessarily. The residual property system mainly deals with the difference between the remaining assets of the couple after marriage. If the actual method of settlement can be agreed upon, it can be designed on a case-by-case basis, including cash, installments, real estate, or other property arrangements; if no agreement can be reached, it will be handled through litigation and subsequent enforcement procedures.

Further reading

[2026 Latest] How is property divided in a divorce? First, preserve the evidence, then proceed with additional calculations and provisional seizures.

If you discover that your spouse transferred assets before the divorce, do the following four things: 1.
