If the death is due to a sudden illness and there is no fault attributable to the driver, in principle, no criminal liability will be established. Conversely, if the driver fails to fulfill their duty of inspection, causing the passenger to be trapped and die from heatstroke, dehydration, or lack of timely rescue, then negligent homicide may be involved.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In practice, it cannot be concluded that the driver is responsible for the death simply because the driver did not patrol the vehicle. The duty of care, foreseeability, and the causal relationship between negligence and death must still be established.
