If Big S did not leave a will, according to regulations, her husband Gu Junye and her two children would be able to divide the inheritance equally, with each receiving 1\/3. However, the lawyer revealed that although the legal heirs do not include her ex-husband Wang Xiaofei, if Wang Xiaofei obtains custody of the two children, he will most likely control 2\/3 of the inheritance left by Big S.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Attorney Li Yusheng from Fidelity Law Office stated that Gu Junzhao is Big S&#039;s legal spouse and according to the law he has the right of inheritance. If he wants to give up the inheritance, the estate will be inherited by the other two children. So in principle, S&#039;s mother cannot obtain the estate, unless Gu Junzhao inherits the estate first and then gives all the estate to S&#039;s mother. This inherited part of the estate has nothing to do with Wang Xiaofei. After Big S passes away, the custody of the child will belong to the biological father, Wang Xiaofei. If S&#039;s family wants to fight for custody, the only possibility is to file a lawsuit to amend custody.
