Since this criminal case occurred in Malaysia, the Malaysian judiciary will conduct the trial first. However, according to Taiwan&#039;s criminal law, Taiwanese judiciary has jurisdiction over cases where a Taiwanese citizen is murdered abroad and the suspect&#039;s crime carries a sentence of three years or more imprisonment. However, because Taiwan and Malaysia do not have an extradition treaty, Taiwan may not be able to extradite Namewee to Taiwan.
