Rhino Shield, a well-known mobile phone case in China, was dissatisfied with its competitor Demon Shield. The iPhone 11 mobile phone case was suspected of imitation. The first case was sued to the court. The second instance judge found that Demon Shield’s mobile phone case was inferior to Rhino Shield in terms of appearance, material, design, etc. Similarly, it violated the Fair Trading Act and therefore lost the second instance. In response, the founder of Devil Shield issued a statement on Facebook, emphasizing that consumers' rights will not be affected and they plan to appeal to the third instance.

Lawyer Li Yusheng of Fidelity Law Firm stated that the judge believed that the Devil Shield’s products, whether in terms of overall appearance, materials, design, patterns, or the “mobile phone fitting room” marketing techniques, are highly similar to the Rhino Shield and are not suitable for ordinary consumers. Therefore, it has caused confusion among consumers and unfair competition in the market. Therefore, it is determined that Devil Shield products violate the Fair Trade Act and need to be held liable for compensation.
