If the family of the driver surnamed Yu handles the inheritance, they will be liable for compensation. Assuming they abandon the inheritance, the victim can seek compensation from the "estate" of the driver who caused the accident. The Legal Affairs Bureau stated that it has completed a provisional attachment to provide the victim with the most basic protection when seeking compensation.
Li Yusheng, an attorney at Fidelity Law Offices, said that a provisional attachment will not become invalid simply because the perpetrator has died, so the perpetrator's existing property will still be attached and his heirs will not be able to transfer it. If the family of the perpetrator handles the inheritance, in principle the heirs will have to bear the compensation obligations, but they will only be liable for compensation within the amount of the inheritance received. If there is a shortfall, the heirs will not be liable for compensation. And if the heir feels that the liability for compensation is too great and therefore abandons the inheritance, it is more likely to lead to a situation where the victim and their family members have no way to seek compensation.
