The Ma Ying-jeou Foundation is embroiled in a financial discipline case, and the situation is escalating. It is understood that the Ma family has filed a lawsuit with the Taipei District Court seeking a "supplementary declaration," which, if successful, could affect Ma Ying-jeou's position as chairman of the foundation. It is rumored that Ma Ying-jeou immediately called his eldest sister, Ma Yi-nan. However, lawyers analyze that in addition to the family needing to provide evidence of Ma Ying-jeou's mental instability, judges, in principle, will also require the respondent to undergo a psychiatric evaluation in supplementary declaration cases.
Attorney Li Yu-sheng of Fidelity Law Firm stated that, according to the Family Law Act, Ma Ying-jeou's family can present evidence of Ma Ying-jeou's mental instability when applying for a declaration of support. In principle, judges will require the respondent to undergo a psychiatric evaluation when hearing such cases. The physician conducting the evaluation will also consider relevant materials submitted by both parties. Therefore, Ma Ying-jeou himself can also provide relevant medical certificates or evidence of his recent public activities to prove that his mental state is not problematic. Finally, the judge will assess whether to grant the declaration of support based on the physician's evaluation results.
