Ko Wen-je has been released on bail. The Northern District Prosecutors' Office will consider whether to appeal after receiving the ruling. However, legal experts believe that the prosecutors will definitely appeal because the High Court rejected Ko Wen-je's appeal on August 11, and at that time it was determined that the reasons for detention still existed. In less than a month, there was no evidence to prove that the necessity of detention had disappeared. However, even if the High Court revokes the bail ruling, Ko Wen-je's detention will not be too long, because according to the charges involving Ko Wen-je, he can be detained for a maximum of 15 months in the first instance.
Liu Yiling, an attorney at Fidelity Law Firm, stated that there should be no reason to continue Ko Wen-je's detention after the conclusion of oral arguments in the first trial or the announcement of the verdict. Furthermore, for the charges against Ko Wen-je, the maximum detention allowed in the first trial was 15 months. Of course, if the trial concludes within 15 months, he could theoretically be detained in the second trial. However, since the evidence investigation and oral arguments have concluded, there should be no concerns about collusion, and continued detention is unlikely to be justified.
