Lawyer Li Yusheng explains

In a press release, Attorney Li Yusheng of Fidelity Law Firm explained that applying for a loan with false information may involve fraud, breach of trust, and document offenses; if bank employees intentionally violate their duties and cause damage to the bank, they may be involved in special breach of trust under banking law. The actual applicable charges should be determined based on each individual's identity, the actions taken, and their subjective understanding.

According to Article 125-2 of the Banking Act, special breach of trust by a bank officer or employee requires the following elements: intent to gain illegal benefits or harm the bank's interests, breach of duty, and damage. The basic penalty is three to ten years; if the property or property benefits obtained through the crime exceed NT$100 million, there is an additional provision for a penalty of seven years or more. The scope of the criminal benefits and the individual's responsibility cannot be determined solely based on the total loan amount reported in the news.

ClarifyCriminal liability for loan fraud casesWhen investigating a case, one should compare the loan application documents, valuation basis, credit approval, fund flow and transaction information to distinguish between general credit risks, oversight negligence, and knowingly cooperating with false information. Those involved should preserve complete original documents and respond to questioning according to law; they should not retroactively create or alter documents or coordinate statements with others.
