If there is a civil lawsuit, can I handle it myself? The answer is yes. However, if you handle the lawsuit yourself, in addition to writing pleadings, holding court sessions, responding to the claims of the other party or the other party's lawyer, and assisting the judge in sorting out the issues in the case, you actually have to do a lot, and it is very trivial and time-consuming. If the case is more complex and involves many legal relationships, it will actually be difficult for the parties to deal with it if they do not have a legal basis. Therefore, if the parties themselves are not able to handle the litigation case themselves, it is a good way to appoint a lawyer to handle it.
Most legal matters between private individuals are regulated by civil law or other relevant laws, such as sales, employment; leasing, contracting, gifts, appointments, etc. Therefore, the aspects involved in civil litigation are relatively cumbersome and complex. Sometimes you can hear people say that if you win a civil lawsuit, you can ask the other party for compensation for attorney fees, etc., as well as how much attorney fees are in general civil lawsuits. This article will introduce and explain.
Regarding civil litigation, you must pay so-called litigation fees, which are commonly known as referee fees. This referee fee must be paid to the court. In general, the plaintiff or the party filing the appeal pays first, and then the party that loses the case will bear it after the court's decision is finalized.
Referee fees are calculated as follows:
According to Article 77-13 of the Taiwan Civil Procedure Law, when suing over property rights, the amount or value of the subject matter of the lawsuit is:
a. For the portion below NT$100,000, NT$1,000 will be levied
b. For the portion exceeding 100,000 yuan to 1 million yuan, 100 yuan will be levied for every 10,000 yuan;
c. For the portion exceeding 1 million yuan to 10 million yuan, 90 yuan will be levied for every 10,000 yuan;
d. For the portion exceeding 10 million yuan to 100 million yuan, 80 yuan will be levied for every 10,000 yuan;
e. For the portion exceeding 100 million yuan to 1 billion yuan, 70 yuan will be levied for every 10,000 yuan;
f. For the portion exceeding 1 billion yuan, 60 yuan will be levied for every 10,000 yuan;
g. If the odd number is less than 10,000 yuan, it shall be calculated as 10,000 yuan.
According to Article 77-14 of the Taiwan Civil Procedure Law, if the lawsuit is not based on property rights, a referee fee of NT$3,000 will be levied.

If you hire a suitable lawyer to assist, you can provide professional legal advice and knowledge, which will be more beneficial to the handling of the case and the conduct of court procedures. Secondly, in Taiwan, lawyer fees in civil litigation are actually paid by each party themselves. The party who hires a lawyer needs to absorb it himself. Even if he wins the case, he cannot ask the other party to pay. This part needs to be paid attention to.
In Taiwan, if it is a civil lawsuit, the legal fees generally range from NT$80,000 to NT$200,000. If the case is more complex or the amount involved is higher, the legal fees may be increased. This article will explore the pros and cons of paying a lawyer and provide some perspective to help you make an informed decision.
Lawyer expertise and experience:
Lawyers have extensive expertise and experience in the legal field, which is of great value. They have spent years studying and practicing law and are therefore able to provide expert legal advice and solutions. Hiring an attorney can take the burden off your shoulders and allow you to focus on other important matters. They will handle the litigation-related document drafting, evidence collection and proceedings, and represent you in court. This will allow you to save valuable time and energy and increase your efficiency in other matters.
Resources and Professional Network:
Attorneys have extensive professional networks and resources, which are extremely valuable when handling a case. They can work with other attorneys, judges, and experts to solve your problem. Lawyers often work with a variety of professionals, such as doctors, accountants, and professional advisors, to provide comprehensive legal services. These resources and networks can increase your chances of success in your case and ensure you receive the best legal support possible.
Prevent legal risks:
Hiring a lawyer is not only suitable for ongoing litigation, but also for preventing legal risks. An attorney can help you review and write contracts, agreements, and other legal documents to ensure your rights and interests are protected. They can identify potential legal issues in advance and provide solutions to avoid future legal disputes. Paying some attorney fees can be a wise investment to avoid legal problems in the future that could cause more damage.
Considering the pros and cons:
However, paying an attorney also requires a comprehensive consideration of the pros and cons. Sometimes, simple legal issues may not require the involvement of an attorney and can be resolved through self-help legal resources or other alternatives. In addition, cost is also an important factor. Before requesting assistance from an attorney, you can discuss the fee structure and expected costs with your attorney to ensure you have a detailed understanding of what you will pay.
in conclusion:
The value of paying a lawyer is their expertise, experience and ability to provide you with professional legal representation and solutions. Although the cost can sometimes be higher, in many cases it is a worthwhile investment that saves time, effort, and ensures that your rights are protected.
