Kao Hung-an was sentenced to 7 years and 4 months in prison for embezzlement in the first instance for allegedly fraudulently obtaining assistant fees. Today (the 16th), the High Court announced its second-instance verdict, overturning the embezzlement charge against Kao Hung-an and sentencing her to 6 months in prison for forgery, which can be commuted to a fine. The key point is that the High Court judges believed that the assistant fees of the Legislative Yuan were a substantive subsidy for legislators and had room for flexible use. Kao Hung-an and others did not have the intention to defraud, so they believed that it did not constitute the crime of embezzlement.
