Due to the epidemic, the government coordinated with many hoteliers to open anti-epidemic hotels so that travelers returning from the United States or other foreign countries could have a place to complete quarantine and isolation.
If the passenger's flight is adjusted or even canceled, the date of booking the epidemic prevention hotel will inevitably need to be adjusted accordingly. Even if the flight is canceled, the passenger will not be able to stay in the epidemic prevention hotel. In addition, the government’s epidemic prevention policy is revised on a rolling basis. If a passenger has paid, but due to flight adjustments, changes in government epidemic prevention policies or even flight cancellations, the passenger cannot check in at the epidemic prevention hotel on the date he originally paid for the epidemic prevention hotel, can the passenger apply for a refund?
In this case, since these circumstances, such as airline adjustment of flights and changes in government epidemic prevention policies, are beyond the control of passengers, they are reasons that cannot be attributed to both parties. According to the provisions of the civil law, the deposit paid by the passenger can be claimed returned.
In addition, according to the "Principles for Handling Tourist Reservations, Cancellations and Refunds" issued by the Consumer Protection Council of the Executive Yuan, if a passenger is unable to check in as scheduled due to epidemic prevention regulations or due to home isolation, home quarantine, or strengthened independent health management, individual passenger reservations can be made. Point 9 of the matters to be recorded in the standardized contract stipulates that the hotelier shall return all deposits and other fees paid without interest.
If the traveler misunderstood the relevant epidemic prevention regulations when booking a room, causing him to book an epidemic prevention hotel for a few extra days, there is no force majeure involved in this situation, so he may not be able to apply for a refund.
