Lawyer Li Yusheng of Fidelity Law Firm said that if the death penalty is returned after the Attorney General files an appeal, the High Court will need to retry the case. If the death penalty conditions explained by the justice are met, the death penalty may still be imposed. If it is determined after the trial that the death penalty should not be imposed, the sentence may be commuted to life imprisonment or fixed-term imprisonment. Regarding death row inmates with physical and mental disabilities, the justice believed that they may not be able to fully understand their actions at the time of the crime, and therefore held that the death penalty cannot be imposed. As for Huang Chunqi and others, the reason was that the only death penalty provision in the criminal law at that time was unconstitutional. However, if the case is remanded for trial, the death penalty may still be imposed if other conditions required by the justice are still met, such as unanimous decision.
