Regarding death row inmates with physical and mental disabilities, the justice believed that they may not be able to fully understand their actions at the time of the crime, and therefore held that the death penalty cannot be imposed. As for Huang Chunqi and others, the reason was that the only death penalty provision in the criminal law at that time was unconstitutional. However, if the case is remanded for trial, the death penalty may still be imposed if other conditions required by the justice are still met, such as unanimous decision.
