In recent years, fraud syndicates have become more and more rampant, and their fraud techniques have evolved with each passing day. Now, for the first time in China, there has been a case of setting up a "fake base station" to send phishing text messages to defraud personal information. The criminal methods of the criminals have also been exposed. It is understood that when fraud groups use equipment to send text messages, the victim's mobile phone signal will be forced to connect to a "fake base station". At this time, the criminals will disguise themselves as any signal source or phone number and send text messages to people's mobile phones. Enticing the other party to click on the website or leave personal information.
Lawyer Li Yusheng from Fidelity Law Firm stated that according to the provisions of the Telecommunications Law, if a fraud group intends to use wired, wireless or other electromagnetic means to intercept or misappropriate communications from other people's telecommunications equipment with the intention of illegally benefiting itself or a third party, it will be punished with a five-year fine. A prison sentence of not more than 1.5 years and a fine of not more than NT$1.5 million may be imposed. Anyone who manufactures, alters, or imports telecommunications equipment with the intention of allowing himself or a third party to intercept or misappropriate telecommunications equipment for communications shall be sentenced to fixed-term imprisonment of not less than one year but not more than seven years, and may also be fined not more than NT$3 million. The same applies to those who sell, transfer, rent or lend telecommunications equipment with the intention of allowing a third party to intercept or misappropriate telecommunications equipment for communications. Anyone who possesses the telecommunications equipment specified in the preceding paragraph with the intention of committing a crime for himself or a third party shall be sentenced to fixed-term imprisonment of not more than three years, and may also be fined not more than NT$500,000.
