Simply poaching employees is not necessarily illegal, but if it involves improperly obtaining trade secrets, customer information, technical documents, or violating non-compete agreements, it may result in civil and criminal liability.
If a company lacks the authority to control and access records, encryption, confidentiality agreements, and employee departure management, it will be more difficult to claim trade secret protection in the future.
The search area, seized materials, and case details should be confirmed first. Internal procedures and authority records should be preserved, and lawyers should be immediately assigned to assist with the investigation and subsequent defense.
