According to ETtoday News, a Taiwanese woman was found dead in her hotel room in the Kawaguchiko area of Japan while on vacation. Another Taiwanese woman was arrested by Japanese police at the scene with a knife. The relationship between the two women, the details of the crime, and their motives are still under investigation. Different reports have given conflicting accounts of whether they were on the same tour group or shared a room, so it is inappropriate to draw conclusions based on these discrepancies. Besides the investigative procedures in Japan, whether Taiwan also has the right to prosecute and adjudicate such cases is a key point of concern.
In an interview, Attorney Li Yu-sheng of Fidelity Law Firm pointed out that the fact that the crime occurred in Japan does not necessarily mean that Taiwan has no criminal prosecution or trial jurisdiction. If the conditions for application of Taiwan's criminal law are met, even if the perpetrator has been tried or imprisoned in Japan, they may still face investigation and trial by Taiwanese judicial authorities upon returning to Taiwan.
When a Chinese citizen is involved in a crime abroad that carries a minimum penalty of three years' imprisonment, and the law of the place where the crime was committed also applies, Article 7 of the Criminal Law may, in principle, apply.Foreign crimeHowever, a definitive judgment in a foreign country does not automatically preclude sentencing in our country; but according to Article 9 of the Criminal Code, a person who has already served all or part of a sentence in a foreign country may be exempted from serving all or part of the sentence. Each case still needs to clarify the charges, evidence, and progress of foreign proceedings, and it cannot be directly inferred that repeated imprisonment is inevitable.
