Another data breach has rocked the Taipei and New Taipei City real estate brokerage industry. A real estate agent surnamed Lin is suspected of colluding with community security personnel to illegally collect and sell a large amount of people's personal data for profit. Yesterday (August 8), prosecutors launched a search operation and summoned Lin and three other related individuals for questioning. However, Lin could not provide clear answers regarding the source of the data and the identities of the buyers, and he also deleted files. Prosecutors determined that he was at risk of colluding with and destroying evidence, and arrested him in court and applied to the court for his detention and prohibition of contact.
Lawyer Li Yusheng of Fidelity Law Firm stated that if real estate agents use such illegal databases to develop clients, it constitutes an infringement of personal data and violates the Personal Data Protection Act, which is a criminal offense. According to the law, they are subject to imprisonment for up to five years or a fine of NT$1 million. If this personal data is provided to fraud groups, they may also be considered an accomplice or accessory to fraud. In addition, since these databases contain information on high-ranking government officials, if this information is leaked to the mainland or hostile forces, it may also constitute a violation of the National Security Act, which carries a sentence of more than seven years in prison.
