According to TTV News, during the investigation into the underground money exchange case, prosecutors discovered that police officers were suspected of illegally accessing citizens' contact information for use by a group through connections made by retired police officers. Prosecutors allege that between 2018 and 2022, a total of 901 records were involved, with payments exceeding NT$7.2 million. The charges include bribery, leaking confidential information, and violations of the Personal Data Protection Act; however, the court will determine the guilt or innocence of the individuals involved.
In an interview, Attorney Zhao Zhiyun of Fidelity Law Firm pointed out that the statutory penalty for bribery can be life imprisonment; when multiple offenses are involved, attention must also be paid to the combined sentence for multiple offenses. According to the Anti-Corruption Act, if a public official makes demands, makes promises, or accepts bribes in violation of his duties, the statutory penalty is life imprisonment or imprisonment for a term of ten years or more, but each case still requires proof of violation of duties and the quid pro quo relationship between the bribes.
The same event may involveTake bribesWhile 901 records constitute 901 separate offenses, they do not automatically equate to 901 individual crimes, nor can the penalties for each offense be simply added together. The court must still determine the number of acts, the division of labor among participants, the relationship between proceeds of crime and the number of offenses, and then determine the appropriate sentence. Records of inquiries, payments made, and communications are crucial evidence for clarifying liability.
