Sanli News and Society Center/New Taipei Report
A New Taipei broadcast girl complained that she was assaulted and her breasts were removed, and she finally collapsed and committed suicide. Lawyer Li Yusheng said that if the police did not include it in the record, they would be in danger of dereliction of duty.
In November last year, a 25-year-old girl named Dai was attacked in the chest and slapped by a guest named Wu while she was sitting on the stage in Sanchong. However, after she was finally charged with disturbing order, the Sanchong police held a press conference. Publicizing the discovery of a mass brawl made her feel that she was being treated in this way even though she was a victim. She believed that the police enforced the law unfairly, so she filed a complaint with the New Taipei District Prosecutor's Office, but before the results were announced, she collapsed and committed suicide. The family members accused the Sanchong Police Station of flaws in the investigation. Lawyer Li Yusheng said that the breast attack involved the crime of forced indecency, which was a crime of non-complaint but judgment. The police should record the relevant circumstances in detail in the transcript and hand it over to the prosecutor for subsequent investigation.
Lawyer Li Yusheng said that there are three ways for people to protect themselves by reporting crimes.
Lawyer Li Yusheng said that Dai was attacked on the chest and slapped, which led to a conflict. This behavior was suspected of the crime of forced indecency under Article 224 of the Criminal Law, and was a crime that was subject to non-complaint. The relevant persons had been arrested by the police and records were produced. The police should record the relevant circumstances in detail in the transcript and hand them over to the prosecutor for continued investigation. The police may be derelict in their duties if they fail to note this part in the transcript. The police held a press conference immediately after the incident. If the general public could learn Dai's identity and criticize her, it would also violate the principle of non-disclosure of investigation under the Criminal Procedure Law.
Although he is clearly a victim, he is regarded as an accomplice in the fight. Lawyer Li Yusheng said that in order to avoid reporting the case to the police and causing controversy, it is recommended that the public should pay attention to the following matters when reporting the case: First, pay attention to the transcript produced by the police when reporting the case to ensure that The content is correct. If any errors or unspecified areas are found, please ask the police to correct or supplement them immediately. Second, you need to obtain a triple report form issued by the police. If the police do not provide it, be sure to ask the police for it. Third, confirm the name, number and unit of the police officer in charge. Fourth, if you are treated unfairly by the police, it is recommended to seek the assistance of a lawyer to avoid misunderstandings.
If there is any suspicion that the police did not perform their duties well afterwards, lawyer Li Yusheng also suggested that for the original case, it is recommended to ring the bell or file a criminal complaint directly with the District Attorney's Office. For the case part, you may consider hiring a lawyer for assistance, or complain directly to the inspectorate office of the local police station to protect your own rights and interests.
