Are Hong Kong people who come to Taiwan to open shops and do business getting caught up in a landlord feud?! Mr. Zhang runs a restaurant on the second floor of a triangular shop in Ximending, Taipei. But in the early hours of the 10th, the landlord, who owns the property rights to the other floors, blocked off the only entrance to the second floor, the stairwell, making it impossible for him to do business. He accused the landlord of using underhanded tactics to try to evict them in order to fight for the property rights to the second floor.
Lawyer Li Yusheng from Fidelity Law Firm stated that if access to the second floor requires passing through the first-floor area, the first-floor owner is legally obligated to allow second-floor residents to pass. If the first-floor owner arbitrarily blocks the staircase leading to the second floor, in addition to infringing on the second-floor residents' right of passage, it may also constitute a criminal offense of coercion. If the dispute persists, it is recommended that second-floor residents report the matter to the police or directly file a criminal complaint or civil preliminary injunction in court to maintain their right of passage.
