A seal creates a family revolution! In September last year, a woman in Beicheng City secretly carved her husband's seal, went to the household registration office to register her birth, and gave her child her mother's surname. When her husband found out, she was furious and took the matter to court. The wife was eventually sentenced to two months in prison.
Walk into the store, write your name, and get the stamp in less than a few minutes.
Most businesses do not specifically check documents before engraving, but in the past, family revolutions occurred due to stolen seals and forged documents.
Reporter Yang Xinyi: "Generally speaking, the couple can jointly decide whose surname the child will have after birth, and sign and seal the agreement. However, a woman in Beicheng City stole her husband's seal and asked the child to take the mother's surname and finally give it to the family. The birth registration was successfully processed by the government office.”
The man surnamed Li angrily sued his wife. The two parties produced a record of the conversation at the court session. The husband said, "If you don't sign the agreement on the children's surnames, they won't be able to see a doctor if they get sick." The wife responded, "What's your surname?" The other party said, "The child's surname is The last name! You don’t mean it casually.”
The judge believed that the plaintiff did not consent and did not authorize the engraving of the seal. Considering that the defendant had no criminal record and confessed to the crime, the judge finally sentenced him to 2 months in prison and optionally a fine.
People: "My parents would probably like to have one child... Maybe if they have two children in the future, one may take the father's surname and the other the mother's surname. But speaking of myself, I don't actually have any particular preference." so."
People: "The current situation is that (the child will take the father's surname). In fact, there is no objection to the discussion, so that's fine. (Then if the child later wants to take the mother's surname, do you think it's OK?) Yes."
After the relative revision of the Civil Code in the Republic of China in 1996, children no longer have to take their father's surname. Most people's ideas have gradually become more open, or they will reach an agreement before getting married.
Lawyer Li Yusheng: "It is recommended that the couple communicate with each other beforehand and make the agreement in writing. If there are concerns about disputes, they can be witnessed by a lawyer or notarized by a notary to strengthen the legal effect."
For a family to secretly engrave a seal on their child's surname, the family went to court and I'm afraid it has damaged the harmony between the couple.
