According to Era News, Chang Chun-chieh, a co-defendant in Kao Chin Su-mei's corruption case, went missing after allegedly tampering with an electronic bracelet while on bail of NT$10 million and under electronic monitoring. The Taipei District Court subsequently issued an arrest warrant and filed related charges. The report also raises concerns about whether the co-defendant's absconding might affect Kao Chin Su-mei's subsequent compulsory measures, as well as the investigation and trial of existing evidence such as cash flow records, accounting books, and witness testimonies.
Attorney Hsu Wan-wei stated that after a co-defendant flees, the prosecutor may re-examine whether other defendants pose a risk of fleeing, destroying evidence, or colluding with accomplices or witnesses. However, the court must still assess each defendant's specific circumstances and determine whether there are grounds for detention and the necessity of detention. It cannot directly assume that other defendants must also be detained simply because a co-defendant has fled. Regarding the substantive aspects of the case, existing bank statements, account books, seized documents, and previous testimonies will not, in principle, disappear due to the flight of one co-defendant, and therefore may not necessarily change the overall direction of the investigation and trial. However, if the flight prevents witnesses from appearing in court or affects subsequent cross-examination, the court may still reassess the proceedings and related enforcement measures.Criminal casesIn China, detention is not a pre-punishment, but a procedural measure to ensure the smooth progress of prosecution, trial, or execution. Ultimately, the court should be based on the specific evidence it possesses.
