After the constitutional interpretation, public opinion believed that it was almost equivalent to the de facto abolition of the death penalty, but in January this year, the Ministry of Justice executed Huang Linkai again. Human rights groups protested that it was essentially a surprise execution and successively filed extraordinary appeals against the 36 death row inmates to avoid such a surprise situation from happening again. All cases have now been sent to the Supreme Prosecutors' Office, where they have been divided and handed over to individual prosecutors for review. If the requirements for an extraordinary appeal are met, the Attorney General will file an extraordinary appeal.

Attorney Li Yusheng of Fidelity Law Offices said that according to the Implementation Guidelines for the Execution of Death Penalty Cases announced by the Ministry of Justice, death penalty cases can be carried out without retrial, extraordinary appeal, request for interpretation by the Grand Justices, or presidential pardon. Therefore, human rights groups have filed an extraordinary appeal with the Attorney General for the 36 death row inmates currently in prison. Avoid being sentenced to death before the Supreme Court’s constitutional interpretation has been applied. However, the circumstances of these death row inmates are different, and whether their requests for extraordinary appeals can be granted also depends on individual case review.
