The well-known braised food shop "Shanghai Lao Tian Lu" in Ximending, Taipei, was sued for allegedly occupying land belonging to the private Taipei Renji Hospital. The lawsuit sought to have the shop demolished and the land returned. "Shanghai Lao Tian Lu" lost the first instance trial, and the original shop subsequently moved out and returned the land. However, the two parties still disputed compensation for land rent. After an appeal, the High Court ruled on the 3rd that "Shanghai Lao Tian Lu" must pay over NT$2.01 million in compensation. The case is subject to appeal.
Attorney Li Yusheng of Fidelity Law Firm stated that this case involves a dispute over unauthorized possession after the termination of a land lease agreement. Since the lessee failed to return the land upon the expiration of the lease, unjust enrichment was established. The owner, Renji Hospital, was legally entitled to sue for the demolition of the building and the return of the land, and to claim compensation for the land use during the period of occupation. The first instance court ordered the return of the land, and the owner has since demolished the building and returned the land. The second instance court ordered a supplementary calculation of compensation for the subsequent period of occupation.
