According to TTV News, the second wave of searches has begun in the Chao Chi Group embezzlement case, with prosecutors investigating suspected misappropriation of company funds and investment funds. The former general manager, who briefly served as chairman, is suspected of colluding with accountants to create false accounts and was released on bail of NT$1 million after questioning. Bail is a compulsory measure during the investigation and does not indicate a guilty verdict by the court.
In an interview, Attorney Wan-Wei Hsu of Fidelity Law Firm focused her analysis on the client's actual authority in managing finances and how the falsified accounts were subsequently used. Legal liability cannot solely depend on the length of the chairman's term; it is also necessary to ascertain whether the chairman participated in the disposal of funds, was aware of the falsification of the accounts, and whether they conspired with others to carry out the relevant actions.
If someone knowingly prepares accounting vouchers or records entries with false information, or uses related information to obtain investment or financing, they may be involved in commercial accounting laws and other criminal provisions, and the matter must be judged based on the conduct and evidence.Company funds misappropriatedIn cases involving such matters, it is advisable to first preserve bank transactions, summonses, signatures, and communication records, and verify the purpose and instructions of each transaction. Accomplices should not be presumed solely based on professional titles.
